2. The present application has been filed for modification of the order dated 19-08-2023, passed in Cr. Misc. No. 51081 of 2023 (Annexure-1), by which the petitioner was granted anticipatory bail in connection with Bakhri PS Case No. 188 of 2021, pending in the Court of learned CJM, Begusarai, and the petitioner was directed to surrender in the learned court below within a period of six weeks and furnish bail bonds.
3. Learned counsel for the petitioner submits that petitioner was out of station to earn his livelihood and, therefore, he could not surrender in the learned court below
Patna High Court CR. MISC. No. 502 of 2024(2) dt.12-01-2024 2/2 well within time on account of the reasons beyond his control. It is further submitted that further time may be extended so that the petitioner could surrender in the learned Court below and furnish bail bonds.
4. Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the learned court below is extended for a further period of six weeks from today. The rest of the conditions stipulated in the order will be same.
5. The order dated 19-08-2023, passed in Cr. Misc. No. 51081 of 2023, is modified to the extent as indicated above.
