The petitioner apprehends his arrest in Barahiya P.S. Case No. 134 of 2018, registered for the offences punishable under Sections 8, 20(b)(i)(c), 25 and 29 of the N.D.P.S Act. 47 K.G. of Ganja is said to have been recovered from a pick-up van. On query, the driver of the said pick-up van disclosed that the said Ganja was handed over to him by the petitioner.

It is submitted by learned counsel appearing on behalf of petitioner that petitioner has falsely been implicated in this case. Nothing has been recovered from his conscious possession. Petitioner has got clean antecedent. Considering the facts aforesaid and the fact that huge quantity of Ganja was recovered and petitioner appears to be

Patna High Court CR. MISC. No.75793 of 2019(2) dt.27-11-2019 2/2 indulged in trade of illicit Ganja, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
