The petitioner is in custody since 05.01.2018 in connection with Kothi P.S. Case No. 31 of 2017 for the offence registered under Sections 341, 323, 427, 435, 387, 504, 506 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is not named in the first information report. Subsequently, his name has transpired on the basis of the confessional statement of co-accused, namely, Akil @ Akil Khan. It is further submitted that there is no further evidence against the petitioner save and except the confessional statement of Akil @ Akil Khan made before the police, which has no evidentiary value.

No.21415 of 2018 (3) dt.09-05-2018 Considering the aforesaid facts and circumstances of the case and that the co-accused Sadab Khan @ Lallu Khan has been granted regular bail in connection with the same case by the Additional District and Sessions Judge VIIIth, Gaya in B.P. No. 409/2017/2716/2017 vide order dated 16.01.2016, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Sherghati, District - Gaya in connection with Kothi P.S.
