The petitioner seeks bail in connection with Excise Case no. 104 of 2018 registered under Sections 30(a) of Bihar Prohibition & Excise Act-2016.
86.250 lts. of foreign liquor is said to have been recovered from the vehicle and the petitioner who happens to be driver of the said vehicle was apprehended while two persons sitting on the same managed to escape.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has been falsely implicated in the case at the instance of his enemy. He has no concern
Patna High Court Cr.Misc. No.20453 of 2018(2) dt.13-04-2018 2/2 with the seized liquor. He happens to be simple driver of the vehicle and had no knowledge of carrying the aforesaid liquor in the gunny bag by the commuters who managed to escape seeing the police party. He has no criminal antecedent. He has been languishing in custody since 09.03.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Excise Case no. 104 of 2018.
