The petitioner seeks bail in a case registered under Sections 341, 323, 307, 379, 384, 34A of the Indian Penal Code and 27 of the Arms Act.
The prosecution case, in short, is that the brother of the informant was assaulted by the accused persons. On the information, when the information reached at the P.O., his brother and neighbours were found lying in injured condition. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-08-2019. Charge sheet in this case has already been submitted. The
Patna High Court CR. MISC. No.74846 of 2019(3) dt.05-03-2020 2/2 petitioner has been falsely implicated in the present case. There is allegation of firing on the thigh of victim, which is non-vital part of the body. There is case and counter case between the parties. It has further been submitted that the petitioner may be released after completion of nine months in custody. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that after completion of nine months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 329 of 2019.
