2. The petitioner seeks bail in connection with Bidupur P.S. Case No. 168 of 2023 registered for the offence under Section 341, 323, 447, 324, 307, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, the main assailant of the deceased is Ratan Kumar and the petitioner and other accused persons are said to have caught hold of the deceased.

4. It has been submitted on behalf of the petitioner that he is innocent and other similarly situated co-accused persons namely Sonu Kumar, Nawal Kumar and Kishor Kumar have been granted bail by this Court vide order dated 16.1.2024

Patna High Court CR. MISC. No.83721 of 2023(4) dt.10-04-2024 2/2 passed in Cr. Misc. No. 70131 of 2023.

5. The petitioner is in jail since 1.7.2023.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 168 of 2023.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
