The petitioners apprehend their arrest in Barun P.S. Case No.34/2018 registered under Sections 147, 149, 341, 323, 325, 379, 308, 504 and 506 of the Indian Penal Code. The informant named nine persons including seven petitioners and alleged that they all came out fro the bush and assaulted his cousin with stick, iron rod and Garasha. Parwal Paswan, the petitioner no.1 is alleged to have assaulted Mantu, the cousin of the informant with farsha on his head and Shyam Paswan, who is not the petitioner, is alleged to have assaulted with

Patna High Court Cr.Misc. No.25021 of 2018 (3) dt.18-05-2018 2/2 iron rod on the leg of Mantu.

Learned counsel for the petitioners submits that nine persons are alleged to have assaulted Mantu but only two injuries were found. The doctor kept the opinion reserved with regard to nature of injury and advised for x-ray but from perusal of the case diary, it appears that x-ray report was not produced by the injured. Both the injuries are superficial and deemed to be simple in nature.

Taking into consideration the aforesaid fact, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Barun P.S. Case No.34 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Amit/- U T
