2. The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 363, 366A/34 of the Indian Penal Code.
3. It is a case of abduction of informant's minor daughter, 15 years old, when she had gone out of the house for some work. During search, he came to know that petitioner Irshad Alam had enticed her for marriage purpose with the help of his family members.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. In statement of 164 Cr.P.C. victim has not supported the prosecution story. Out of her own sweet will,
Patna High Court CR. MISC. No.83142 of 2023(3) dt.19-03-2024 2/2 she has left her house because her parents had fixed her marriage with an aged person. She has not raised any finger against the petitioner for any overt act. Petitioner has got no criminal antecedent and languishing in judicial custody since 1.10.2023.
5. Learned APP appearing for the State has opposed the prayer of Bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Janta Bazar P.S. Case No. 80 of 2021.
