The petitioner, who is mother-in-law of the deceased, seeks anticipatory bail in connection with Behera P.S. Case No.356 of 2019 registered for the offence under Section 304-B/34 of the Indian Penal Code.

It has been contended by the petitioner that she is the mother-in-law of the deceased and the allegations are general and omnibus.

Learned APP for the State assisted by learned counsel for the informant has pointed out that the husband of the deceased was staying in Delhi and the deceased was staying in the house along with mother-in-law and father-in-law. It has been contended that the deceased died in her matrimonial home. Though the final opinion with regard to death has not

Patna High Court CR. MISC. No.80793 of 2019(5) dt.26-10-2021 2/2 come but, in the inquest report as well as postmortem report ante-mortem injury / injuries was found upon the deceased. In these circumstances, in my opinion, it is not a fit case for grant of anticipatory bail. Hence, the prayer for anticipatory bail is rejected.

Learned counsel for the petitioner has produced before me an order dated 18.11.2019 passed in Criminal Miscellaneous No.70056 of 2019, by which, other co-accused persons have been granted regular bail by a coordinate Bench of this Court.

The Court below will consider the case of the petitioner on its merit as and when she surrenders. The Court below will also consider the fact that other co-accused persons in the present F.I.R. have been granted regular bail by this Court.
