The petitioner, already in custody, seeks bail in connection with Fatuha P.S.Case No. 381 of 2017 registered under Sections 147,120B,302 and 341 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that informant along with his uncle and brother including the petitioner were returning back to home from an auto rickshaw and on the way, on the opposite direction, one vehicle intercepted the auto and other persons came down and exhorted the petitioner, who was sitting in the tempo, to kill the informant's uncle. Thereafter, he took out pistol and shot on the head of the uncle causing his death. Submission is that prosecution case appears absurd, the petitioner is said to be also one of the passengers in the auto moreover, he has been implicated due to land dispute.

Patna High Court Cr.Misc. No.22533 of 2018(3) dt.26-06-2018 2/2 Whereas learned counsel for the State submits that there is specific accusation against the petitioner of killing the deceased and other persons at the spot also supported the allegation.

Having considered the specific accusation against the petitioner, the prayer of bail is rejected. Trial court is directed to expedite the trial.
