Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 4.8.2017 passed in Cr. Misc. No.34905 of 2017 on merit.

Submission of the learned counsel for the petitioner is that the case has been lodged by the Dafadar and earlier there was direction to conclude the trial within a period of one year but the trial has not been concluded. It is also submitted that even the police paper has not been supplied to the petitioner and the case has been committed to the court of session.

Heard learned A.P.P. also.

Having heard both sides and from perusal of the report it appears that through video conferencing the petitioner

Patna High Court Cr.Misc. No.22412 of 2018 (3) dt.09-05-2018 2/2 was produced and his learned Advocate was called to accept the police paper but he refused and thereafter the petitioner was also physically present before the court but he also refused to accept the police paper and the aforesaid fact has been denied by the learned counsel for the petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. With the aforesaid observation, this application is dismissed.
