JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks bail in connection with Begusarai Rail P.S. Case No. 21 of 2019 registered for the offences punishable under Sections 8, 20(b)(ii) B of N.D.P.S. Act. Prosecution case relates to recovery of more than 12 Kg. of ganja from the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated only on suspicion and he has no criminal antecedent and he is in custody for more than six months and charge sheet has been submitted and even as per FIR recovery of ganja is less than commercial quantity. Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However,

Patna High Court CR. MISC. No.74394 of 2019(2) dt.13-01-2020 2/2 once charge has been framed in this case, petitioner at at liberty to renew his prayer for bail.

This application is, accordingly, dismissed.
