Mr. Sri Ajay Kumar-1 ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-06-2018 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in connection with Riga P.S. Case No. 193 of 2017 registered for the offence punishable under sections 363, 366A of the Indian Penal Code. Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to dirty village politics. As a matter of fact, the petitioner no.1, Chandan Kumar and the victim girl were in love from before and they on their own sweet will eloped from their house.

Patna High Court Cr.Misc. No.22224 of 2018(3) dt.04-06-2018 2/2 Petitioners have no concern with the alleged occurrence. It is further submitted in paragraph 92 of the case diary, statement of the victim girl under section 164 Cr. P.C. has been recorded in which she has said that she has not supported the allegation of kidnapping rather she stated that she has married with Chandan Kumar with her own sweet will. Moreover, the matter has been compromised between the parties and a joint petition to that effect has also been filed.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 193 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
