JUSTICE ARUN KUMAR ORAL ORDER 10-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 1.12.2017, seeks bail in Main PS Case No. 24 of 2016 registered under Sections 387, 34 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation in brief is that three persons came on a motorcycle making demand of extortion at the construction site of the pool from the contractor and two persons were apprehended from whose possession some arms and other materials were recovered and they disclosed that the petitioner was also along with them who succeeded in fleeing away.

Learned Counsel for the petitioner submits that only material against the petitioner is disclosure of his name in the confessional statement of apprehended accused and except that there is no other material, he is not member of gang of extremist outfit and has clean antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Ramjanam Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VI Gaya in connection with Main PS Case No. 24 of 2016.
