2. The petitioner apprehends his arrest in connection with Mahammadpur P.S. Case No. 135 of 2024 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.
3. Allegedly, while the son of the informant was cutting bamboo to repair his house, in the meantime, all the FIR named accused persons including the petitioner arrived there and started abusing him. It is specifically alleged that this petitioner assaulted the son of the informant by means of axe due to which he sustained serious injury.
4. Learned counsel for the petitioner contended that

It is further contended that though the occurrence took place on 17.05.2024 but the FIR has been instituted on 05.06.2024 without there being any explanation for the delay. It is next contended that the injury sustained to the son of the informant is simple in nature. Moreover, the petitioner bears fair antecedent and he undertakes that he will fully cooperate in the proceedings of the Court.
5. On the other hand, learned counsel for the State opposed the bail application and submitted that the petitioner caused serious injury to the son of the informant.

Regard being had to the submissions made on behalf of the parties and considering the delay in lodging of the FIR, coupled with the case and counter case and the fair antecedent of the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gopalganj in connection with Mahammadpur P.S. Case No. 135 of 2024, subject to the condition as laid down under Section 438(2) of
Patna High Court CR. MISC. No.81866 of 2024(2) dt.11-12-2024 3/3 the Cr.P.C, with further condition that one of the bailors shall be the own/close family members of the petitioner. (Harish Kumar, J) rohit/- U T
