2. The petitioner has prayed for bail in connection with Taraiya P.S. Case No. 295 of 2024 registered for the offence punishable under Sections 126(2), 303(2), 352, 351(2) (3), 64 and 3(5) of the B.N.S. and Section 67 of the I.T. Act.
3. The case of the prosecution is that the petitioner has made a video of informant while she was having bath four years ago. It is further alleged that the petitioner established physical relationship on the basis of the said video. It is also alleged that he has threatened the informant that he will make the video viral. It is also alleged that while establishing physical relationship, the petitioner has again made the video and on the
Patna High Court CR. MISC. No.80962 of 2024(5) dt.05-02-2025 2/3 basis of that video has taken Rs. 7 lakhs and jewellery from the informant. It is also alleged that the family members of the petitioner also demanded cash and jewellery from the informant on the basis of that video.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He is a cloth seller and he has helped the informant and to substantiate it, he has filed Annexure-2 which is the photocopy of the transfer of amount which has been made in the account of the informant. It is also submitted that there is nothing in the diary to show that the video was made viral. The video was made four years ago but the case has been filed after such a long gap. There is also no medical examination of the victim. Petitioner is languishing in judicial custody since 18.07.2024.
5. The application for bail is opposed by learned APP for the Stated and learned counsel for the informant.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
