Although it has been incorporated at the end of OP No. 2/complainant that petitioner along with accused, Santosh Kumar Singh came at his place and disclosed regarding availability of land belonging to Santosh as well, it is evident that negotiation was finalized with Santosh, money was taken by Santosh as well as by his father, cheques were issued by his father, namely, Birendra, a deed of Jarbeyana (part performance) was executed whereupon, petitioner stood as one of the witnesses.

Accordingly, petitioner, Md. Chand Alam is directed to be released on bail in the event of arrest or surrender within
