Mr. Uday Pratap Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 28-11-2025 Heard Mr. Pankaj Kumar Sinha, learned Advocate for the petitioners and Mr. Uday Pratap Singh, learned Additional Public Prosecutor for the State.
2. The petitioners apprehend their arrest in connection with Chakai P.S. Case No. 72 of 2023, registered for the offences punishable under Sections 447, 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
3. The allegation against the petitioners is of causing assault to the informant and others by means of lathi, danda and tangi resulting into some unfortunate injuries.
4. Learned Advocate for the petitioners submitted that the parties are close agnates and live in the same courtyard,
Patna High Court CR. MISC. No.78257 of 2025(2) dt.28-11-2025 2/3 however, only on account of a trifle, they entered into a free fight resulting into some unfortunate injuries. The injuries sustained to the injured Dinesh Das and Saraswati Devi have been found to be simple in nature as is evident from the impugned order. Petitioners are persons of fair antecedents and they undertake that they will fully cooperate in the proceeding of the court. It is lastly contended that be that as it may with regard to an occurrence, which took place on 23.02.2023, the present FIR came to be instituted on 02.03.2023 and as such false implication of the petitioners cannot be ruled out.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners have actively participated in the crime.
6. Regard being had to the submissions advanced by the learned Advocates for the respective parties and considering the delay in institution of the FIR coupled with the simple nature of the injuries and the fair antecedent of the petitioners, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to

Case No. 72 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
