The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 354B, 307, 504, 506 read with 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the informant and her daughters were cutting grass and they damaged the crops that is why some altercation took place. The police after investigation submitted charge-sheet under Sections 341, 323, 354, 506 and 34 of the Indian Penal Code. No offence under Section 354(B) of the Indian Penal Code is made out as there was no intention to outrage modesty rather some scuffle

Patna High Court CR. MISC. No.72923 of 2019(2) dt.22-11-2019 2/2 took place while the informant and her daughters were cutting grass. Learned counsel for the petitioners submits that similarly situated co-accused has been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 57450 of 2019 on 18.09.2019. He further submits that petitioners have no criminal antecedent as stated in para-3 of the bail petition. In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Raniganj Police Station Case No. 93 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
