The petitioner seeks bail in anticipation of his arrest in connection with Ishakchak P.S. Case No. 13 of 2018 dated 20.01.2018 instituted for the offences under Section 392 of the Indian Penal Code.

The informant was divested of his mobile telephone on gun point by four miscreants. One such person was arrested immediately on hot chase who disclosed the name of the petitioner as one of the persons who had run away from the place of occurrence. Learned counsel for the petitioner has submitted that his implication in the present case is only on the basis of the confession made by an arrested accused person. That apart, it has also been submitted

Patna High Court Cr.Misc. No.21538 of 2018(2) dt.26-04-2018 2/2 that the aforesaid person (co-accused) who took the name of the petitioner was having some dispute with the petitioner.

Considering the entire set of circumstances, the informant has taken a conscious decision of not prosecuting the petitioner any further. For the aforesaid purpose, he has approached the court below and has made the court known that he does not wish to prosecute the petitioner any further.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 13 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
