The petitioner seeks bail in connection with Raghunathpur P.S. Case No. 168 of 2025 instituted for the offence under Sections 126(2), 115(2), 118(1), 109, 352, 303(2), 351(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

Prosecution case, in short, is that on 20.06.2025 at 8 PM, the accused allegedly abused and assaulted the informant's family, causing injuries by pelting stones and throwing a khanti. Thereafter, they entered the house, assaulted her father-in-law, and looted her mangalsutra, cash Rs. 17,000/-, and jewellery worth Rs. 1,00,000/- before fleeing. 4.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.77093 of 2025(2) dt.18-11-2025 2/3 that the petitioner is in custody since 10.08.2025. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation against the petitioner, rather the same is general and omnibus in nature, which is evident from bare perusal of the impugned order. Learned counsel for the petitioner mainly submits that similarly situated co-accused person has been enlarged on anticipatory bail by a Co-ordinate Bench of this Court vide order dated 10.09.2025, passed in Cr. Misc. No. 62996 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Raghunathpur P.S.
