JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Harsidhi P.S. Case No. 405 of 2017 for the offences punishable under sections 341, 323, 325, 354 (B), 379, 504 and 506/34 of the I.P.C. The allegation against the petitioner in the FIR is that he pulled Sari of Bhabhu of the informant resulting Sari was opened and she became necked and then she fled away in the room.
Submission is of false implication and that there was no intention to open the Sari, there is no allegation that the

No.21255 of 2018 (2) dt.27-04-2018 2/2 petitioner with any bad intention committed any overtact, no offence under section 354 (B) of the I.P.C. is made out, there is a case lodged by the petitioner which is of earlier date and to save the skin from that case he has been implicated in this case and as such the petitioner deserves sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.
In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M, East Champaran at Motihari in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
