The petitioner apprehends his arrest in connection with Suryagarha P.S. Case No. 196 of 2019 for the offence punishable under Sections 147, 148, 149, 323, 325, 307, 379 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the accused persons having assaulted the petitioner and others.

The learned counsel for the petitioner has submitted that a general and omnibus allegation has been levelled against the petitioner and in fact, the co-accused persons have already been granted the privilege of anticipatory bail, one of such order being the one passed in Cr. Misc. No. 78264 of 2019 dated 02.12.2019 and the other being the one

Patna High Court CR. MISC. No.71791 of 2019(4) dt.05-03-2020 2/2 passed in Cr. Misc No. 73174 of 2019 dated 03.12.2019. It is further submitted that the petitioner has been falsely implicated in the present case and has got no complicity in the matter. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties as also taking into account the parity of the case of the petitioner with those of the co-accused persons who have already been granted the privilege of anticipatory bail by co-ordinate Benches of this Court, I deem it fit and proper to confirm the Provisional Bail already granted to the petitioner vide order dated 27.11.2019.

The petition stands allowed.
