JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

Neither petitioner is named in the first information report nor he was put on test identification parade, particularly, in the circumstance when petitioner is in jail custody since 28.07.2019. However, it appears that two mobile sets are said to have been recovered from conscious possession of the petitioner which is claimed to be looted property but submission on behalf of the petitioner is that the aforesaid recovered mobiles belong to petitioner.
