2.The accused/petitioner is named in the F.I.R. and apprehending his arrest in connection with Kankarbagh P.S. Case No. 645 of 2025 registered for the offences punishable under Section 69 of the BNS and Sections 66(E) and 67(A) of the IT Act.

As per FIR, petitioner established physical relation ship with informant, who is a major and married lady, thereafter starting blackmailing her for continuing physical relation, failing which captured video of their private moments may be made viral through social media. It is also alleged that informant's social media handle was hacked by this petitioner and its access was taken by him for uploading obscene photo. It is also alleged that petitioner forced informant to leave her husband and children and to stay with him.

It is submitted by learned counsel appearing on behalf of the petitioner FIR itself suggests that petitioner was acquainted with informant through social media and she came to hotel on her own, where she established physical relation with this petitioner. It is pointed out that this is a case of extra marital affair and when the relation of informant came into the knowledge of her husband and family members, present false case was lodged. It is also pointed that this is not a case to establish physical relationship on false pretext of marriage. It is also pointed out that photographs as appears annexed with FIR running from page no. 21 to 24 of the present petition nowhere suggests that any obscene or adult photo qua informant was uploaded to social media by this petitioner. While concluding argument, it is submitted that petitioner found involved in one more criminal case where he is in on bail.
5 Learned APP while opposing the prayer of bail submitted that specific allegation of rape is available against this petitioner.
6. In view of aforesaid factual submission and by taking note of fact as prima-facie allegation suggest that it is a case of extra marital affair, where photographs annexed with FIR, primafacie nowhere suggesting that same are obscene or regarding any

No.79072 of 2025(2) dt.19-11-2025 3/3 private moments of petiioner with informant, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XI, Patna/concerned Court, where the case is pending in connection with Kankarbagh P.S.
