Petitioner seeks bail in a case registered for the offences punishable under Sections 328, 302 and 120B/34 of the Indian Penal Code.

The FIR does not disclose that the victim was being tortured by the petitioner and other in-laws for nonfulfillment of dowry demand. After investigation, the police has submitted charge-sheet under Section 306/34 of the Indian Penal Code. However, there is no material to substantiate that the suicide was direct result of the abetment of the petitioner. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.21667 of 2018 (3) dt.03-07-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Jokihat Police Station Case No. 297 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
