The petitioner is apprehending arrest in a case registered for the offences punishable under Section 392 of the IPC The prosecution case as per the written report of Manish Kumar dated 29.08.2017 is to the effect that the petitioner being the Manager of Bharat Finance Limited at Bidupur was returning back after collecting the invested money from different customers, in the meantime, three persons who had their face covered and were on a motorcycle, they intercepted the informant and snatched the cash amount of Rs.1,40,000/- and mobile and gadgets from the informant, on gunpoint.
Learned A.P.P. opposed the prayer for bail and submitted that it is a case of road robbery and one co-accused was arrested
Patna High Court Cr.Misc. No.23182 of 2018 (2) dt.26-04-2018 2/2 by police and looted articles were recovered from him and arrested accused Vikram Kumar disclosed the name of this petitioner with specification that he was liner to commit a crime. It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent. Considering the facts aforesaid and the fact that petitioner's name sprang up in the confession of the co-accused, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No.262 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
The bail bond of the petitioner will be accepted by the learned Court below on filing affidavit that he will cooperate with the trial and non-cooperation in the investigation, will give liberty to the prosecution to file application for cancellation of bail. Sanjeev/- (Dinesh Kumar Singh, J) U T
