The petitioners seek bail in Sanhaula P.S. Case No.153 of 2019 registered under Section 272, 273 and 34 of the Indian Penal Code and under Section 30(a) of Bihar Prohibition and Excise Act.

The petitioners according to the secret inputs were carrying wine on an auto rickshaw but seeing the police, the petitioners started fleeing away. 300 pouches each containing 200 ml. country made liquor, 6 bottles each containing 750 ml. of Blunder Pride and 6 bottles each containing 750 ml. of Signature were recovered from the auto rickshaw. The learned counsel for the petitioners submits that petitioners are father and son. They were passengers in the auto

Patna High Court CR. MISC. No.76864 of 2019(2) dt.11-12-2019 2/2 rickshaw. The driver of the auto rickshaw managed to flee away and the petitioners had no knowledge that the driver of the auto rickshaw was carrying liquor in the bag. Petitioners are in jail since 22.08.2019. Petitioners have already remained in jail for more than three months.

Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd A.D.J.- cum-Special Judge, Excise Act, Bhagalpur in connection with Sanhaula P.S. Case No.153 of 2019.
