The petitioner is apprehending his arrest in connection with Saharsa Sadar P.S.Case No.18 of 2018 registered for offences punishable under Sections 13,1 8, 27A, 28/36 (AC) Drug and Cosmetic Act, 1940.

Allegation against the petitioner is of selling cough syrup and other drugs without having valid licence and when the police raided, he fled away.

Submission of the learned counsel for the petitioner is that on disclosure of the other accused his shop was raided and some articles were seized but the shop is in the name of his brother and he has valid licence till the year, 2021 and further the cough syrup has been purchased recently and as such it could not be entered

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be granted provisional bail for a period of one month and in the meantime, the petitioner will produce licence and other papers to the Drug Inspector, who will examine validity of the same and if it is found correct, the petitioner shall be granted provisional bail by the learned court concerned otherwise his bail bond shall be cancelled.
