JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Industrial Area P.S. Case No. 85 of 2019, disclosing offences under Sections 406 and 420 of the Indian Penal Code. Petitioner happens to be owner of the truck, which was booked by a transport company for carrying Namkeen later on the truck became traceless along with loaded article. Submission of learned counsel for the petitioner is that petitioner is the owner of truck and the truck was taken by the driver and he has falsely been implicated in this case. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court

No.74474 of 2019(2) dt.20-01-2020 2/2 below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Industrial Area P.S. Case No. 85 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner will cooperate in investigation of the case and appear before the police as and when required.
