The petitioner seeks pre-arrest bail in connection with Kasim Bazar P.S. Case No.144 of 2017 registered under Section 406 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that there is no truth behind the allegation that after appearing in the Joint Examination conducted by the DCECE (PM/PMD/PE), 2017, the petitioner took away his OMR answer sheet. He submitted that the Centre Superintendent may be responsible for causing loss of OMR answer sheet of the petitioner, but just in order to save her own skin she has made a false complaint against

On the other hand, learned counsel for the State submitted that these days such complaints are being frequently received and attempts are being made by the examinees to use unfair means in competitive examinations.

Be that as it may, looking at the nature of allegation and and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No.144 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
