The petitioners apprehend their arrest in connection with Ujjiarpur P.S. Case No. 236 of 2012 registered under Sections 328 and 302/34 of the Indian Penal Code. The accusation is of killing of sister of the informant by her husband and in-laws at her matrimonial house. Learned counsel for the petitioners submits that petitioners are father-in-law, brother-in-law and Nandosi of the deceased, sister of the informant, in fact, on the occasion of Chuth festival, informant came at the house of the petitioners

Patna High Court CR. MISC. No.78611 of 2019(2) dt.03-12-2019 2/2 with Chath Prasad and thereafter, when informant started to move from there then his sister gave pressure to take at her parent's house but informant refused due to that reason, sister of the informant committed suicide. Further submission is that after investigation, police submitted the final form but the learned trial court differing with the final form took cognizance against the petitioners and others. It is further submitted that informant after realizing the real fact filed an application in the court of ACJM, Dalsinghsarai on 05.01.2013, in which, informant stated that he had filed the case due to misconception.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Dalsinghsarai, in connection with Ujjiarpur P.S. Case No. 236 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
