JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 Petitioner apprehends his arrest in connection with Bangoan P.S. Case No. 141 of 2017 registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires on the basis of a mobile which was used in the occurrence has been seized.
Submission of learned counsel for the petitioner is that he is a student and he has falsely been implicated in this case and the SIM used in this case is not in the name of the petitioner and he is no concern with the occurrence and he has no criminal antecedent and ready to abide by any condition that may be imposed on him. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.24936 of 2018 (4) dt.25-06-2018 2/2 circumstances, let the petitioner, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Saharsa, in connection with Bangaon P.S. Case No. 141 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that in his future, if he is involved in such type of cases, his bail bond shall be cancelled.
