The petitioner seeks regular bail in connection with Parsa Bazar P.S. Case No. 15 of 2017 for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.
The allegation is regarding the accused persons having taken away the son of the informant on a motorcycle and thereafter he is said to have been killed by them. The learned counsel for the petitioner submits that as far as the petitioner is concerned, barring the present case there is no other case pending against him. It is further submitted that all the other accused persons have already been granted bail by this Court by various orders, some of which have already been
Patna High Court Cr.Misc. No.23913 of 2018 (4) dt.02-07-2018 2/2 annexed with the present petition. It is further submitted that the petitioner having a clean antecedent and is languishing in custody since 04.02.2017.
Par contra, the learned counsel for the informant has submitted that the case of the petitioner is different from coaccused Ravi Kumar. This Court is of the opinion that this is not the fact.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Patna in connection with Parsa Bazar P.S. Case No. 15 of 2017.
