The petitioner seeks bail in connection with Barachatti P.S. Case no. 208 of 2018 registered under Sections 30(a), 38, 47 of Bihar Prohibition & Excise Act-2016. 38 lts. of country made liquor and 9 lts. of foreign liquor are said to have been recovered from a Maruti car and petitioner who happens to be its driver was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor. He had no knowledge of carrying the said liquor in the aforesaid vehicle by its commuter who managed to
Patna High Court Cr.Misc. No.23472 of 2018(2) dt.26-04-2018 2/2 escape seeing the police party. He has been falsely implicated in the case at the instance of his enemy. He has no criminal antecedent. He has been languishing in custody since 20.03.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Barachatti P.S. Case no. 208 of 2018.
