JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Sirdalla P.S. Case No. 86 of 2014 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 337, 427, 379 and 307 of the Indian Penal Code. It appears from perusal of the record that charge sheet has been submitted but petitioners were not sent up for trial and later on after examination of five witnesses a petition has been filed by learned APP under Section 319 Cr.P.C., on that summons have been issued against the petitioners to face trial along with other accused persons.

Patna High Court CR. MISC. No.74183 of 2019(2) dt.21-11-2019 2/2 Heard both sides.

In view of above facts and circumstances, this application is disposed of with direction to the petitioners to surrender in the trial court and pray for regular bail, which shall be considered by learned trial court keeping in view of the fact that petitioners were not sent up for trial and, if possible, to be disposed of on the same day.
