Petitioner seeks bail in connection with Akilpur P.S. Case No. 11 of 2017 registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that he got information that his sister strangulated herself in her in-laws' house and when he reached in-laws' house of his sister,he found that all the family members were absconding and on enquiry from the villagers he came to know that in-laws have murdered his sister and petitioner along with other villagers have cremated the dead body.

It has been submitted by the learned counsel for the petitioner that he is innocent, does not belong to in-laws family

Patna High Court Cr.Misc. No.22253 of 2018(2) dt.19-04-2018 2/2 of the deceased and is a villager. He submits that it is only on suspicion that the petitioner has been made accused along with his unmarried daughter. He submits that the petitioner is ready to cooperate with the investigation and provide all necessary information and not tamper with the prosecution witnesses. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur, Patna, in connection with Akilpur P.S. Case No. 11 of 2017, subject to the condition that the petitioner will cooperate in the investigation and provide all necessary information and shall not tamper with the evidence or the prosecution witnesses.
