JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-12-2023 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the informant solemnized the marriage of his daughter with one Rupesh Das on 01.03.2023 but after three days of her marriage, she came to her parent's house. The victim, thereafter, came in contact with one Indrajeet Das and 20 days prior to the date of occurrence, said

No.80503 of 2023(2) dt.18-12-2023 2/3 Indrajeet Das took the daughter of the informant with him and they both started living as husband and wife in the house of Indrajeet Das. On 11.06.2023, the informant came to know that his daughter has been killed by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. The petitioners are parents of said Indrajeet Das and they had got no concern with the day-do-day affairs of his son Indrajeet Das and the deceased. During the course of investigation, no cogent material evidence was collected against the petitioners to connect them with the present offence. The petitioners are languishing in custody since 12.06.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

No.80503 of 2023(2) dt.18-12-2023 3/3 Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S. Case No. 154 of 2023.
