The petitioner seeks regular bail in connection with Runni Saidpur P.S. Case No. 349 of 2015 for the offences punishable under Sections 302/34 of the Indian Penal Code. The allegation is regarding the husband of the informant having gone to sleep on the roof of one Parmeshwar Sah and in the morning the said Parmeshwar Sah informed the informant that the husband of the informant has been killed.
The learned counsel for the petitioner submits that no evidence whatsoever have been collected during the course of the investigation to implicate the petitioner in the present case. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 25.1.2018. Lastly, it is

No.22160 of 2018 (3) dt.28-06-2018 2/2 submitted that the trial of some of the accused persons has been separated and the evidence of the informant of this case has been recorded in the said trial wherein she has categorically stated that she is not having the knowledge as to who had killed the deceased. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S. Case No. 349 of 2015.
