1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioners submits that initially the FIR was not instituted under Section 307 I.P.C.,
Patna High Court CR. MISC. No.79900 of 2025(2) dt.08-12-2025 2/2 hence the petitioners had surrendered before the learned trial Court and were released on regular bail, but police after investigation submitted charge-sheet under Section 307 I.P.C. based on which cognizance also came to be taken, as such, petitioners apprehend their arrest.
3. The learned A.P.P. submits that once petitioners surrendered before the learned Trial Court whether anticipatory bail application would be maintainable?
4. At this stage, the learned counsel appearing on behalf of the petitioners seeks permission to withdraw the present anticipatory bail application with liberty to move before an appropriate forum for seeking appropriate relief.
5. Permission is accorded.
6. Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
