2. Petitioner apprehends arrest in a case registered for the offence punishable under section 380 of the IPC .

3. As per the prosecution case, there is recovery of stolen motor pump from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner claims clean antecedent.

5. Learned counsel for State opposes the prayer for bail and submits that specific allegation against this petitioner is that the alleged motor pump in question has been recovered

Patna High Court CR. MISC. No.83660 of 2023(4) dt.18-04-2024 2/2 from his house and witnesses in their statement in para 2,9, 10 of the case diary has supported the prosecution case .

6. Considering the aforesaid facts and circumstances and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected.
