The petitioner seeks regular bail in connection with Amdabad P.S. Case No. 65 of 2023 instituted for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code.
It is a case of assault upon the informant by means of lathi, danda and iron rod and also abusing filthy language to the wife of the informant by the accused persons including the petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that no specific allegation of assault against him and injury
Patna High Court CR. MISC. No.81573 of 2023(2) dt.05-01-2024 2/2 upon the wife of the informant is found to be simple in nature. Petitioner has got no criminal antecedent and he is in custody since 21.08.2023.
Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of the case and submissions made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Amdabad P.S.
