JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Bhawanipur (Balia) P. S. Case No. 117 of 2019, disclosing offences under Sections 457 and 380 of IPC. As per F.I.R. petitioner, who is named in the F.I.R. that he along with other accused persons entered inside the house of the informant and committed theft of Rs.5 lacs and other articles.

Submission of the learned counsel for the petitioner is that he is the villager of the informant and he has falsely been implicated in this case, due to enmity and the other accused who is also named in the F.I.R, has been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 18.10.2019 passed in Criminal Misc. No. 62041 of 2019. Further submission is that he has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Bhawanipur (Balia) P. S. Case No. 117 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
