Petitioner, already in custody since 5.1.2018, seeks bail in Chausa PS Case No. 144 of 2014, registered under Section 302/34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that ten FIR named accused persons made indiscriminate firing on the informant's brother as a result of which he died, two of the co-accused persons Awadhesh Singh and Biran Singh were chased by the villagers and caught. Submission is that there is allegation of opening indiscriminate firing against ten accused persons but only two fire arm injuries were found on the person of the deceased and similarly situated other co-accused Purushottam Singh, Bablu Kumar and Ranjit Singh have been admitted to bail by different coordinate Benches of this Court.

Having considered the said facts and circumstances, the petitioner Kapildeo Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Udakishunganj, Madhepura in connection with Chausa PS Case No. 144 of 2014.
