====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 447, 341, 323, 324, 325, 307, 504, 506, 379/34 of the Indian Penal Code.

3. As per the prosecution case, informant alleged that on 7.6.2024 at about 11.30 pm, while she was going to sleep, in the meantime, all the FIR named accused persons including these petitioners armed with lathi, rod, sword, etc. entered the house of the informant and abused her. Accused persons assaulted the informant and her husband. Petitioner no.1 attacked informant's husband on the back of his head with a rod in his hand, whereas petitioner no.2 hit informant's husband on his head with a sword.

4. It is submitted on behalf of the petitioners that

Patna High Court CR. MISC. No.82117 of 2024(5) dt.29-04-2025 2/2 there is land dispute between the parties for which section 144 Cr.P.C. proceeding had also been inisiated between them. Alleged land is of the petitioners. Doctor has found simple injury. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in Jamui Police Station Case No. 352 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
