The petitioner seeks regular bail in connection with Bakhtiyarpur P.S. Case No. 540 of 2017 for the offences punishable under Sections 364A of the Indian Penal Code. The allegation is regarding the accused persons having abducted the victim boy.

The learned counsel for the petitioner submits that the victim boy in his statement under Section 164 Cr.P.C. has named three accused persons as his abductors who are namely, Vivek, Guddu and Rocky. However, the petitioner has not been named by the victim boy. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 06.12.2017.

Patna High Court Cr.Misc. No.23586 of 2018 (6) dt.02-07-2018 2/2 Per contra, the learned counsel for the informant has opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S.
