2. The petitioner is apprehending his arrest in connection with Halai P.S. Case No. 10 of 2024 instituted for the offences under Sections 341, 323, 324, 379, 307, 504 and 506/34 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner attempted to fire at the informant but the informant caught his hand, meanwhile, fired was made but the gunshot did not hit the informant rather it passed besides his head.

4. Learned counsel for the petitioner has submitted that the reason behind this occurrence is that co-accused Motilal Sharma who is the son of the informant has sold a piece of land to the wife of the petitioner. He submitted that there is also a

From perusal of the impugned order, it transpires that the informant sutained injury which was caused by hard and blunt substance and no fire-arm injury was found on the person of the informant. It is next submitted that the only allegation against the petitioner is of attempt of firing. Moreover, the petitioner having two criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Samastipur in connection with Halai P.S. Case No. 10 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashok Kumar Pandey, J) Arish/- U T
