The petitioner seeks regular bail in connection with Saraiya P.S. Case No. 476 of 2017 for the offences punishable under Sections 302/34 of the Indian Penal Code. The allegation is regarding the Police having conducted raid, upon receiving a secret informant to the effect that a gang of thieves was planning to commit loot from the A.T.M. Upon raid being conducted by the Police, various accused persons were caught and as far as the petitioner is concerned, one loaded country made pistol and a Samsung mobile as well as two live cartridges were recovered.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he is having a clean antecedent as well

Patna High Court Cr.Misc. No.23194 of 2018 (4) dt.29-06-2018 2/2 as has been falsely implicated in the present case and is languishing in custody since 23.12.2017. It is further submitted that similarly situated co-accused persons have been granted bail vide order dated 22.5.2017 passed in Criminal Misc. No. 21611 of 2018 and Criminal Misc. No. 21803 of 2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge, 1st cum A.C.J.M., 1st (West), Muzaffarpur in connection with Saraiya P.S. Case No. 476 of 2017. (Mohit Kumar Shah, J) S.Sb/- U T
