2. The petitioner seeks regular bail in connection with Supaul P.S. Case No. 715 of 2023, registered for the offences punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution case, one Bolero pick-up vehicle was looted in which chicken was loaded which belongs to the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the F.I.R. has been lodged against unknown persons and during investigation, the stolen vehicle was found in front of the petitioner's shop and due to that reason, the petitioner has been apprehended. He further submits

Patna High Court CR. MISC. No.82123 of 2023(3) dt.08-02-2024 2/2 that the informant has implicated the petitioner due to business rivalry, as the petitioner has also the chicken farming in his name. He also submits that the petitioner is in custody since 11.09.2023 having clean antecedent and the charge sheet has already been submitted in this case. There is no chance of absconding with the petitioner or tampering with the evidences.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Supaul P.S. Case No. 715 of 2023 subject to the condition that the petitioner undertakes to cooperate in the trial and shall be represented properly on each and every date fixed by the Trial Court.

7. With this observation, the present bail application stands allowed.
