The petitioner seeks bail in connection with Islampur P.S. Case No.391 of 2019 registered under Sections 25(1-B)(a), 26 and 35 of the Arms Act.
It is submitted by the learned counsel for the petitioner that the police have implicated the petitioner falsely in the present case. Though, the petitioner was apprehended on 24.08.2019, he was produced before the Magistrate on 29.08.2019, the date on which he was remanded to judicial custody. It is further contended that the petitioner has got no criminal antecedent.
Learned counsel for the State has opposed the application for grant of bail to the petitioner. He submitted that
Patna High Court CR. MISC. No.71069 of 2019(2) dt.04-12-2019 2/2 since the petitioner suffered accident and was taken to hospital first, there was delay in producing him before the Magistrate. Be that as it may, considering that the investigation of the case is over and the custodial interrogation of the petitioner is not warranted, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa, Nalanda in connection with Islampur P.S.
